1. Scope of Application

These Terms of Service apply to all contracts concluded between Jean-Louis Kempfe (hereinafter “Seller”, “we”, “us”) operating under the name 3D-Print-Guild and the customer (hereinafter “Customer”, “you”) via our online shop.

Any deviating terms of the Customer shall not apply unless we have expressly agreed to them in writing.

2. Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the order button, you submit a binding offer to purchase the selected goods. We will confirm receipt of your order by email. A binding contract is only concluded when we accept your order by sending an order confirmation or by shipping the goods.

3. Prices and Payment

All prices are quoted in Euro (€) and include the statutory value-added tax (VAT), where applicable. Shipping costs are indicated separately during the ordering process.

Payment is due immediately upon conclusion of the contract. We accept the payment methods displayed in the checkout process.

4. Delivery and Shipping

Delivery times are stated on the respective product page or during the ordering process. As most of our products (including articulated flexi dragons) are manufactured individually after the order is placed, production and delivery times may vary.

The risk of accidental loss or deterioration of the goods passes to the Customer upon handover to the shipping carrier (for consumers: upon delivery to the Customer).

5. Retention of Title

The goods remain our property until full payment has been received.

6. Right of Withdrawal

Consumers have a statutory right of withdrawal. Details can be found in our separate Return and Refund Policy.

Please note that the right of withdrawal does not apply to goods that are made to the Customer’s specifications or are clearly personalized. This applies to the majority of our 3D-printed products, as they are manufactured individually after the order is placed.

7. Warranty (Statutory Liability for Defects)

Statutory warranty rights apply. If the delivered goods are defective, you are entitled to the rights under German law (subsequent performance, reduction of the purchase price, withdrawal from the contract, or damages under the statutory conditions).

8. Liability

We are liable without limitation for damages resulting from injury to life, body or health caused by intentional or negligent breach of duty by us or our legal representatives or agents.

For other damages, we are only liable in cases of intent or gross negligence. In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract.

9. Intellectual Property and License

All 3D models sold by us are printed under a valid commercial license (including designs from BiocraftLab via Cubee).

The purchase of a physical 3D-printed product does not grant you any rights to the digital design files. Resale, distribution or reproduction of the digital files is strictly prohibited.

10. Custom / Made-to-Order Products

Most of our products are manufactured individually after the order is received. Once production has started, cancellation is generally no longer possible. Color and minor dimensional variations inherent to 3D printing technology do not constitute a defect.

11. Final Provisions

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the Customer is a consumer and has their habitual residence in another EU country, mandatory consumer protection provisions of that country remain unaffected.

Should any provision of these Terms of Service be or become invalid, the validity of the remaining provisions shall not be affected.
